Violation of the Reights of the Inhabitants of House No.48 Bldg.3 on Leningradsky Prospekt

House No.48 bldg.3 on Leningradsky Prospekt in Moscow was built in  1893. For a long time the building was in emergency state. By the way, the majority of flats are communal. They were long in insanitation but are still inhabited by people.
The inhabitants of house No.48 held the building examined more than once at their own expense, but these yielded one conclusion:the building is not suitable for living. However, the authorities of Northern administrative district of Moscow where the emergency house is situated did not take any actions of settling its inhabitants in a new place or reconstruction for a long time.
In September 2008 в произошло a serious collapse of the ceiling happened in one of the flats. Fearing for their lives, the inhabitants were forced to move to tents which were placed in front of their flats. Only after that the officials responded the situation. Yury Hardikov, prefect of NAD came to the scene and commanded to settle the situation.


The officials «settled» it rather quickly. One of the rooms of the communal flats where the collapse happened was inhabited by the Zotov family. They as well as other inhabitants were granted with a new flat of the so-called manoeuvre fund. But the temporary living was in such a state что that the Zotovs, with two family members being invalids with severe illnesses, preferred to wait in their communal flat for a permanent place for living.
By the end of 2008 года a real settling from the dilapidated house in new flats began. But it goes with violation of the inhabitants’ rights.
So, the Zotov family were offered a two-room flat, grounding on the standard social norm – 18 square metres per person. Meanwhile in compliance with article 17 of Federal Law No. 181 «On social protection of invalids in the Russian Federation» invalids have the right for an extra living area what Valentina Zotova told not once the prefecture of NAD and Department of municipal living. Violations of the family’s rights was that she was granted a living area in a different place from where they had lived before, in Aeroport district. Zotov was offered to move to the capital’s suburbs near Moscow Ring Road to Valdaysky proyezd, Levoberezhny district.
Having the legal right for a better living area, the Zotovs refused the offered flat. Now lawyers of IPO «Spravedlivost» represent the interests of the Zotovs in court, as NAD prefecture suited of their compulsory resettlement from the house on Leningradsky Prospekt.
