A letter (Annex 1) concerned with corruption of the leaders of Board of Internal Affairs Of Novokuznetsk, Kemerovo region came from Public Chamber of the RF to IPO «Spravedlivost». As well as a copy of the appeal of lawyer A.B. Makarchuk to Public Chamber of the RF (Annex 2). The lawyer reports in it of the facts of corruption in law-enforcement authorities of Novokuznetsk. The information was received by him by executing of his professional duties of protection of legal rights and interests of his principals.
In July 2007 the position of head of Main Board of Internal Affairs of Novokuznetsk waa taken by militia colonel Sergey Salnikov. From the first days of his work, according to the lawyer’s appeal, he tried to press disagreeable officials off the city’s BIA.
In the first turn persecution was launched against Marina Nesterova, head of financial and economic department of Novokuznetsk BIA, internal service colonel. It was after she told her new head directly that she would not conceal financial violations.
As Marina Nesterova states, Salnikov responded with the promise to dismiss her. Then there was a turn of check-ups of various higher bodies (inspections of the staff of Main Board of Internal Affairs, Board of Social Security of Kemerovo regional NBIA, Financial Economic Board of MBIA of Kemerovo region, staff department of MBIA of Kemerovo region, Criminal Search Department КРО ГУВД, plan revision of MIA of the RF). But none of them detected any violations by M.A.Nesterova.
As it follows from Nesterova’s evidence, December 6, 2007, Aldashkin S.V., head of staff department of MBIA of Kemerovo region and Bulgakov K.A., new head of Financial Economic Board of MBIA of Kemerovo region, threatening to reduce the staff of the department headed by the lieutenant colonel, forced her to write a dismissal statement due to reaching the age of 45.
After the departure of the high-ranking leader, Marina Nesterova recalled this statement (Annex 3).
The invisible fight between the head deprived of infallibility and the principled subordinate flared up anew. According to the information, in January 2008 colonel Salnikov on behalf of Novokuznetsk BIA concluded contracts of lubricants delivery. And almost immediately after Financial Economi department of BIA disclosed facts of embezzlement of these lubricants.
As soon colonel Nesterova stated this to Salnikov, she (in March 2008) was given a notice of dismissal on the basis of ther invalid (recalled) statement. Experienced in such kind of matters the lieutenant colonel shoed complete bewilderment first with the event, and then submitted the copy confirming the recall of her dismissal statement. Officials of the staff service of BIA, in their turn, showed great surprise, and told the lieutenant colonel that they had not received ее заявление the recall of her dismissal statement.
After that Marina Nesterova had no other way out but appeal to the Federal Court of Central district of Novokuznetsk.
Her lawyer Anatoly Makarchuk, after having learnt the documents’ copied given to him, deemed it necessary to submit two statements to the investigation committee of the Prosecutor’s Board of the RF: a statement of purchase of fence for the cottage house of Salnikov, head of Novokuznetsk BIA for budgetary assets (No. ЮЛСК -2746-08 dated 11.09.08) (Annex 4) and a statement of systematic embezzlement of lubricants (No.ЮЛСК – 2889-08 dated 26.09.08) (Annex 5).
On the first of them A.V.Kozlov, investigator of the investigation committee of the prosecutor’s board of Kemerovo region made a check-up. But soon, not finishing it, he declared to the applicant that the action would not be brought into court. Apparently, being the investigator of major cases, Mister Kozlov considered the story of purchase of a fence for the militia head’s cottage house a minor case.
Having been summoned for explanation to investigator Kozlov, M. Nesterova submitted copies of documents from the Financial Economic department of Novokuznetsk BIA confirming the named facts of budgetary funds waste and embezzlement of lubricants. As well as a written statement on this case (Annex 6). Kozlov accepted the documents but he was very much surprised with the Nesterova’s readiness to give damning evidence against the unlawful activities of BIA head.
Three days later Nesterova brought extra explanation to the investigator (Annex 7) but Kozlov rejected to join it to the check-up materials,declaring that he was not interested in it. Simultaneously, the check-up figurant, Sergey Salnikov, head of Novokuznetsk BIA, prohibited Nesterova’s access to financial documents.
Lawyer Makarchuk commented it as follows: «In spite of of the received explanations and documents disclosing the unlawful activities of head of Novokuznetskm BIA, investigator Kozlov A.V. does not conceal his intention te reject in commencing proceedings. Although it is not quite clear how he would motivate it. Indeed, there is the Seller by the documents whicj supplies oil products to the Purchaser –Novokuznetsk BIA. There are acceptance certificate on oil products which state that unknown cars were refueled on behalf ob BIA. The capacity of fuel tanks of some of them was 500 litres (Annex 8). And they were paid with BIA moneys».
Fairly thinking that M.A. Nesterova, as the result of the described actions of Novokuznetsk BIA leaders, fears seriously for safety of her life, health and personal inviolability, lawyer Makarchuk A.B. appealed to the Public Chamber of the RF (Annex 2). Asking to send his letter to the Corruption Opposition Council by the Russian President, General Prosecutor’s Board, Investigation committee of the Prosecutor’s Board. He asked also to take control by the Public Chamber of the RF the procedures detecting concealing of the suggested corruption crimes by the officials of the investigation board of the investigation committee of Kemerovo region, concerning embezzlement of budgetary funds and functional abuse by the leaders of Novokuznetsk BIA.
As it was stated above, the Public Chamber of the RF responded quickly to lawyer Makarchuk’s appeal. The material was submitted to the General Prosecutor’s Board, check-op of the corruptive actions among the leaders of Novokuznetsk BIA was taken under control.
IPO «Spravedlivost» considers the letter of the Public Chamber of the RF manifestation of trust based on the increased authority of our organization in the struggle against corruption. We will try to justify this trust. Presently there is an inquiry already prepared for the Corruption Opposition Council by the Russian President, and a number of other actions. |
